$2 Million Settlement After Truck Crash Leaves Man with Moderate Brain Injury
David Smith sat in his car waiting to turn onto Route 20 in Marengo in October 1999 when a truck driven by David Villareal slammed into Smith’s vehicle, pushing it into oncoming traffic and a collision with a second vehicle.
Smith spent 43 days in the hospital with several back fractures and a moderate traumatic brain injury. Attorneys Peter Flowers and Craig Brown, on Smith’s behalf, filed suit against Villareal and several other defendants shortly after the crash.
The case eventually went to trial, but was settled during the proceedings for just over $2 million. The lawsuit was filed in Cook County under case numbers 99L11861 and 99L12655.
